Alternative Dispute Resolution

Most lawsuits never get tried, but are instead resolved through some form of alternative dispute resolution (ADR). Our lawyers have broad experience in all forms of alternative dispute resolution including mediation, facilitation by neutrals, traditional arbitration, “baseball” arbitration, mock juries, and mini-trials.

We believe in aggressively pursuing alternative dispute resolution to reduce time and costs. Our attorneys pride themselves on the creative use of technology to present their case in the modified ADR format. Many of our attorneys are recognized as leaders in this area and serve as mediators and arbitrators in a wide-range of disputed matters.

Experience in this practice area includes:

  • Mediating more than 60 complex medical malpractice, product liability, and trucking cases, in 17 states this past year.
  • Serving as mediators in contentious business disputes, and professional liability and catastrophic injury cases.
  • Defending physicians in Iowa and in Georgia in binding arbitrations.
  • Serving as one of three arbitrators, along with a former superior court judge and court of appeals judge, in a commercial matter involving a dispute over $14.5 million.
  • Lecturing to audiences of attorneys at continuing legal education seminars on the subject of winning at mediation. 
  • Using experts at mediation to allow for the free flow of information and resolution of complex issues to facilitate settlements.
  • Creating demonstrative evidence that refutes common erroneous allegations against a manufacturer’s product, for use at mediation.
  • Serving on panels of national mediation services.
  • Utilizing fast-track discovery, including depositions of parties immediately before mediation, to reduce costs and promote fact-based mediation.
