Premises Liability
Commercial and private property owners are at risk for potential liability for personal injury and damage suits. Premise Liability includes constructive notice issues, the standard of care in the industry, expert witnesses, security and lighting issues, maintenance and record keeping policies, third party issues, and lessee/lessor contract provisions.
We have experience defending businesses and individuals against premises liability suits. We are conscious of the issues involved, and have the ability to identify suspicious claims and develop evidence to expose them.
Experience in this practice area includes:
- Obtaining a summary judgment and dismissal on behalf of a bowling alley, in a lawsuit arising from a slip and fall, in which the plaintiff alleged that the bowling alley was negligent in applying oil to the lanes and in failing to adequately inspect the lanes for slick spots.
- Defending a slip and fall case against a hotel in Valdosta where the plaintiff claimed to have broken his leg on wet entry steps.
- Litigating a Dram Shop Act liability issue involving a serious auto accident following the consumption of alcohol at a restaurant.
- Representing a variety of retail businesses and grocery stores involving slip and falls on grapes, unknown liquids, ice, water, grease, and other foreign substances.
- Representing a client in a slip and fall case that established new evidentiary standards at trial.
