Constitutional Law

We successfully defended the State Bar of Georgia in a 1st Amendment commercial speech case brought by two attorneys who were sanctioned for violating Bar rules through their means of soliciting clients, advertising, and the use of runners. These attorneys challenged the bar rules as being restrictive and violative of their first amendment rights.  We successfully defended the State Bar through trial and the 11th Circuit.

We successfully defended the State Bar of Georgia in an election related political speech challenge arising out of the sanction of a candidate for violating Judicial Conduct Rules in the course of a political campaign.

We successfully challenged state abortion legislation and had the same declared unconstitutional on the basis of Due Process and Equal Protection.

We successfully prosecuted a sheriff and two deputies showing that the Sheriff retaliated against our clients using pre-textual traffic stops, surveillance, and other threatening actions because our clients exercised their constitutional rights by being involved in the political process and taking a stand contrary to the Sheriff's position. The cause of action was based upon 1st amendment retaliation. This case was prosecuted through the 11th Circuit and through trial where the jury returned a verdict of 9.5 million dollars.
