Nall & Miller is recognized as a national leader in the defense of product liability claims. Our firm serves as National Product Counsel for the world's largest home appliance manufacturer, managing its litigation nationwide. We have defended product manufacturers, distributors, and retailers, in cases involving a wide range of products including medical devices, automobile parts, tires, gas heaters, nail guns, carpet shredders, pallet jacks, fork lifts, vinyl wall covering, fans, and home appliances.
By working closely with our clients' engineers, as well as outside experts, our lawyers have become knowledgeable about technical issues relating to the design, testing, and manufacturing of products. We use this knowledge to successfully challenge the testimony of opposing experts. Our lawyers are active in national organizations such as the Product Liability Advisory Council ("PLAC") and the Defense Research Institute.
Experience in this practice area includes:
- Representing a manufacturer of automatic doors against allegations that the faulty operation of a door caused serious injury.
- Representing a client against claims alleging that the faulty design of a pallet jack caused a machine to fail, injuring a worker.
- Serving as National Counsel to a Fortune 100 manufacturer of appliances, managing and litigating hundreds of cases around the country.
- Trying cases involving personal injury and death.
- Representing a major appliance manufacturer in post-Katrina disaster related litigation, pertaining to allegations of defective ranges in FEMA trailers resulting in alleged propane explosions causing severe injuries to Katrina victims.
- Representing a major appliance manufacturer in anti-tip bracket litigation involving allegations of burned children.
- Representing a major appliance manufacturer in a large multi-duplex building explosion involving catastrophic injuries to multiple persons.
- Representing an exhaust fan manufacturer in a case involving fire damage to a commercial building and damages exceeding $550,000, allegedly as a result of the client's product.
